I have not gotten a sense of any laws or rules that have been broken, but one thing is for sure, those that sell a product need to be careful if they start competing with their customers.
This post at Domain Name News talks about Godaddy keeping expired domains for themselves and not letting all of us scramble for them. Even if they sell them for $5 at TDNAM, they get that AND a yearly registration fee.
